By using Aqaarix, you agree to be bound by these Terms and our Privacy Policy. If you are using our services on behalf of a company or entity, you represent that you have the authority to bind that entity to these Terms.
1. Eligibility and Account Registration
To use Aqaarix, you must be at least 21 years of age (or the legal age of majority in your jurisdiction) and have the legal capacity to enter into a binding contract. You agree to:
- Provide accurate and complete information during registration.
- Maintain the security of your account credentials.
- Notify us immediately of any unauthorized access to your account.
- Ensure your use of the platform complies with all local laws and regulations in your GCC member state.
2. Subscription and Payments
Aqaarix offers various subscription plans (Starter, Growth, Professional). By subscribing, you agree to the following:
- Billing: You will be billed according to your selected plan (Monthly or Yearly).
- Taxes: All prices are subject to applicable taxes, including Value Added Tax (VAT) as required by UAE and KSA law.
- Discounts: Yearly plans include a 20% discount which is calculated and applied at the time of purchase.
- Refunds: Payments are generally non-refundable unless required by law or specified in a separate agreement.
3. Permitted Use
You agree to use Aqaarix only for lawful property management purposes. You shall not:
- Manage properties that you do not have the legal right to manage.
- Upload fraudulent tenant information or illegal contracts.
- Attempt to circumvent our security measures or reverse engineer our software.
- Use the platform for any activity that violates GCC commercial or criminal codes.
4. Intellectual Property
All content, software, and branding on the Aqaarix platform are the exclusive property of Aqaarix or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the platform for its intended purpose during your subscription period.
5. Limitation of Liability
To the maximum extent permitted by the laws of the UAE and Saudi Arabia, Aqaarix shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability for any claim shall not exceed the total amount paid by you to Aqaarix in the 12 months preceding the claim.
6. Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in activities that may harm Aqaarix or its users. You may cancel your subscription at any time, but you will remain responsible for all fees incurred up to the date of cancellation.
7. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Dubai International Financial Centre (DIFC) Courts or the courts of the Kingdom of Saudi Arabia, depending on the user's primary business location.
8. Changes to Terms
We may modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website. Your continued use of the platform after such changes constitutes acceptance of the new Terms.
